Who you are contracting with
Senc0. (“the service”) is provided by Senc0 (“we”, “us”). By purchasing or using the service you are contracting with Senc0. If you are buying on behalf of a school or trust, you confirm you have authority to bind that organisation.
Acceptance
By continuing to use the service you agree to these terms. If you do not agree, stop using it.
What the service is
Senc0. is a workspace for managing SEND provision in schools: a register, concerns triage, Assess-Plan-Do-Review cycles, EHCP review workflow, costed provision and reporting. It is not a management information system, not a safeguarding system, and not a channel for submitting EHC needs assessments to a local authority.
Licence and restrictions
We grant your school a limited, non-exclusive, non-transferable right to use the service within the plan purchased. You must not reverse engineer it, resell or redistribute it, or circumvent technical limits.
Acceptable use
You must not misuse the service. That includes unlawful use, fraud or spam, infringing anyone’s intellectual property, and interfering with security, for example malware, probing, or scraping. You are responsible for keeping account credentials confidential and for activity under your account, and for providing accurate information.
Intellectual property
We retain ownership of the service and all intellectual property in it, including the software, documentation and branding. You retain ownership of the pupil and school data you put into it, and grant us a limited licence to host and process that data solely to provide the service.
Service level
We work hard to keep the service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.
Payment, billing and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. Our own refund commitment is set out in the refund policy.
The v1 founding-school licence is a one-off purchase for software in build. Access is provided on release.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. On termination you may export your data; ask us and we will provide a full export before deletion.
Liability
Our aggregate liability is capped at the fees paid in the twelve months before the claim. We exclude liability for indirect or consequential loss, including loss of profits, data or goodwill. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
Data protection
Your school is the data controller for pupil data; we act as processor. See the privacy notice and data protection pages.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
